Das Verwaltungsgericht Hamburg hatte über die Voraussetzungen zur Mitwirkung im Katastrophenschutz zu urteilen. Das Ergebnis: Antragsteller dürfen nicht voraussetzungslos im Katastrophenschutz mitwirken.

Die Klägerin – eine gemeinnützige GmbH – erbringt Dienstleistungen im Rettungsdienst, auch in Hamburg. Sie beantragte Ende 2019 die vorläufige Zulassung zum Katastrophenschutz, scheiterte aber an der Behörde. Dies tat die Klägerin, weil sie sich in einem Auswahlverfahren um die Beteiligung im Hamburger Rettungsdienst bewerben wollte. Und eben dieses enthielt Vorgaben über die Mitwirkung im Katastrophenschutz. Die Behörde stellte jedoch fest, dass die Mitwirkung eines schriftlichen Antrags sowie der Zustimmung der Behörde bedürfe. Im Rahmen des Verfahrens würden Stärke, Gliederung, Ausstattung und Ausrüstung der Einheiten sorgfältig festgelegt. Ferner bat die Beklagte um weitere Auskünfte zur Stärke und möglichen Einbindung der Kräfte. Das aber konnte die Klägerin – jedenfalls vorläufig – nicht mitteilen.

Das Verwaltungsgericht Hamburg jedenfalls stellte im Wesentlichen fest, dass sich aus dem Hamburgischen Katastrophenschutzgesetz (HmbKatSG) keine Anspruchsgrundlage für eine vorläufige Zustimmung zur Mitwirkung im Katastrophenschutz ergäbe. § 5 Abs. 1 HmbKatSG sähe die Zustimmung der Katastrophenschutzbehörde voraus. Die Zustimmung sei jedoch nicht automatisch und ohne jede weitere inhaltliche Voraussetzung zu erhalten. Die Behörde dürfe vielmehr eine Eignungs- und Bedarfsprüfung auch unter fachlichen Gesichtspunkten durchführen.

Dagegen könne sich die Klägerin auch nicht auf die Berufsfreiheit nach Art. 12 Abs. 1, 19 Abs. 3 oder den allgemeinen Gleichheitssatz nach Art. 3 Abs. 1 GG stützen. Der Schutzbereich der Berufsfreiheit sei nicht eröffnet. Ein Beruf im Sinne des Art. 12 Abs. 1 GG ist jede auf Erwerb gerichtete Tätigkeit, die auf Dauer angelegt ist und der Schaffung einer Lebensgrundlage dient. Die Mitwirkung im Katastrophenschutz diene aber objektiv nicht der Schaffung einer Lebensgrundlage. Und für die Verletzung des Gleichheitssatzes fehle es an einer systematischen Verwaltungspraxis. Im Übrigen bestünde auch kein strikter Rechtsanspruch auf eine vorläufige Zustimmung.

Mitwirkung im Katastrophenschutz

Wer im Katastrophenschutz mitwirken will, sollte sich ein paar mehr Gedanken machen. Der bloße Antrag auf Mitwirkung genügt nicht.

The applicant – a non-profit limited liability company – provides rescue services, also in Hamburg. It applied for provisional approval for disaster control at the end of 2019, but failed to obtain it from the authority. The applicant did so because it wanted to apply for participation in the Hamburg rescue service in a selection procedure. And it was precisely this that contained specifications about participation in disaster control. However, the authority stated that participation required a written application and the approval of the authority. Within the framework of the procedure, the strength, structure, equipment and facilities of the units would be carefully determined. Furthermore, the defendant asked for further information on the strength and possible involvement of the forces. However, the applicant could not provide this information – at least for the time being.

In any case, the Administrative Court of Hamburg essentially found that the Hamburg Disaster Protection Act (HmbKatSG) did not provide a basis for a claim for provisional consent to participate in disaster protection. § Section 5 (1) of the HmbKatSG requires the consent of the disaster control authority. However, consent could not be obtained automatically and without any further substantive requirement. On the contrary, the authority was allowed to carry out a suitability and needs assessment also from a technical point of view.

On the other hand, the plaintiff could not rely on the freedom of occupation under Article 12.1, 19.3 or the general principle of equality under Article 3.1 of the Basic Law. The scope of protection of the freedom of occupation was not open. An occupation within the meaning of Article 12(1) of the Basic Law is any gainful activity which is of a permanent nature and serves to provide a livelihood. Involvement in disaster control, however, did not objectively serve to create a livelihood. And there was no systematic administrative practice for the violation of the principle of equality. Moreover, there was no strict legal entitlement to provisional consent.
